In 2018 the UK Intellectual Property Office commissioned some interesting research on design infringement. If you are a new designer, or an experienced designer with a new product – this will be interesting for you.
The report measures how often infringement of design rights occurs in the UK; it looks at business area and geographic location. It also goes into the different types of design rights.
It looks at attitudes to design rights from the perspective of the designer, and talks about which rights designers value. It further examines the impact it has when those rights are infringed – for example the huge amount of lost revenue.
It also addresses remedies, and what happens when designers have to go to court to try and seek redress and how confident they are in the protection that is offered.
